    Administrative Hearings

    An Administrative Hearing is a legal proceeding, held via telephone or video conference through DCSS. Administrative hearings offer parties the opportunity to contest, for limited reasons, administrative enforcement actions that include:

    • Federal Tax Refund Offset
    • State Tax Refund Offset
    • Passport Denial
    • State Lottery, Video, and Table Games Lottery Offset
    • Credit Reporting
    • Lien/Levy of Assets
    • License Suspension/Denial

    If parties disagree with a proposed administrative enforcement action, they must request an Administrative Hearing, in writing, within the time stated within DCSS’ Notice of Intent (NOI). An individual may appear for an Administrative Hearing with, or without, an attorney. A hearing decision is usually issued within five (5) business days after the Administrative Hearing takes place. A party may appeal the hearing decision to the Family Court within 30 days of the date that the decision was mailed to the parties.
